Elijah Blue Allman's divorce dismissal refiled amid mom Cher's conservatorship request

Elijah Blue Allman's divorce dismissal request from wife Marieangela King has been refiled amid his mom Cher's conservatorship request.
A Los Angeles Superior Court Judge first denied Allman's dismissal on Jan. 11 due to outstanding funds owed from a temporary support stipulation, but on Wednesday the request was refiled, according to documents obtained by USA TODAY Thursday.
King previously noted in the divorce filing that "sporadic and insufficient" spousal support payments from Allman had made it difficult to attend to the divorce proceeding.
In an email, King's lawyer, Regina Ratner, said the Jan. 11 decision was due to a "procedural issue."
USA TODAY has reached out to Allman's lawyer for comment.
Allman's attorney filed a request for dismissal of the case without prejudice in Los Angeles Superior Court on Jan. 2, with King's attorney consenting to the dismissal. Allman, 47, first filed for divorce from King, 36, in 2021 after eight years of marriage.
The divorce dismissal follows an entangled set of legal proceedings that include Cher's conservatorship filing over her son with musician Gregg Allman. On Jan. 5, a Los Angeles Superior Court judge declined to immediately approve the conservatorship request as Cher's legal team did not give Elijah Blue Allman or his attorneys enough time to review the documents they filed, the judge ruled.
The Grammy-winner's lawyers filed the documents on Jan. 2, but the court required them to be sent in at least five days before the Jan. 5 hearing. The court also approved Allman's request to choose which attorneys he'd like to represent him.

Cher claimed in her petition that due to alleged "severe mental health and substance abuse issues," her son is unable to manage his financial assets. Allman objected his mother's petition, arguing that a conservatorship of his estate is not necessary and that his mother is "unfit to serve" in that role, records show.
Allman has previously opened up about his battle with substance abuse.
The next hearing regarding the petition is scheduled for Jan. 29.
The denied divorce dismissal also follows King's accusation that Cher orchestrated a kidnapping plot for her estranged husband in November 2022. In a December 2022 declaration filed in the couple's divorce, King claimed the pop icon arranged for Allman to be removed from their New York hotel room on the night of their wedding anniversary.
King added that in the months leading up to the alleged kidnapping, she was told not to have contact with Allman while he was in "lockdown at a treatment facility." The nature of Allman's treatment was not shared in King's filing.
